A case of a Bangalore. Three men accused of raping a woman. All three of said in their defense that, the case is about prostitution, not rape. Woman Who Knew her, testified that Complainant also works as a sex worker in the night. And she used to take money from all three boys in exchange for sex.
Women have filed a case of a rape because one day boys refused to give the money. The Supreme court held this is not a rape case. All three men were acquitted.
The Supreme Court decision is right, that in the case of non-receipt of the money, you cannot file the case of rape. In fact, the case must be for not receiving the money. But prostitution is a legal crime. So How can women demand money?
Obviously, When sex is by woman’s choice, It cannot be a rape. Now If men do not pay, then women have been deceived, not rape.
Is, therefore, important that prostitution should be legalised. In that case, such fraud may not happen with the women. And men also should not become accused due to false allegations.
There are so many pros and cons in legalising prostitution in India which we will discuss later.
